Worker online j.d.o.o. was registered in the Commercial Court in Rijeka under MB 010112105. The company contract on the establishment of the sompany concluded on June 26, 2017, announces the General terms and Conditions.
The following terms are used in this document:
Agency - Worker online j.d.o.o.
Logistician – Inspire d.o.o. – a company that performs all logistical tasks for an Employee, Employer, Agency or Subcontractor.
Worker – any person who is with Inspire d.o.o. concluded a contract on logistical support in job search, preparation of compete documentation for legal work and/or preparation of documentation for residence and work permit if the worker is outside the EEA.
Employer – any company that has entered into a contract with Inspire d.o.o. in order for the logistician to find and prepare workforce for work.
Subcontractor – a legal entity that takes over the execution of large-scale works on the EEA market.
EEA – European Economic Area
Contract – any Contract entered into with an Employee, Employer, Agency or Subcontractor
Article 1.
The Agency will prepare all the necessary documentation for the worker, acquaint him with the workplace and tasks, will take care of the protection of his labor rights in terms of referral to all legal procedures in the protection of his rights if necessary will hire a law office for legal and professional assistance in exercising rights.
Article 2.
The Employee signs the Employment Contract with the Agency or the Employer, accepts the working conditions and the price of work and cannot charge the Logistician for unpaid work on behalf of the Employer and if it is regulated by a special Contract.
Article 3.
The Agency will make sure that the Employee archives working conditions with the Employer that is in accordance with all applicable laws of the country in which he works and the regulations governing health and safety at work. Furthermore, the Agency will make sure that the Employer treats the Worker like all other workers without any direct or indirect discrimination.
Article 4.
The Employee is obliged to provide the necessary funds for coming to work, for possible interpretation and translation of documentation, if necessary funds for accommodation if the Employer or the Agency has not undertaken this obligation, as well as other means necessary for life until he receives the first salary.
Article 5.
In exceptional situations and at the special request of the Employer or the Agency, the Logistician will, if necessary, assist in financing the workers during their work until they receive their first salary, and everything will be regulated by a separate Contract.
Article 6.
In the case of workers from countries outside EEA, the cost of issuing a residence and work permit will be borne by the Logistician, Employer or Agency. The Agency will prepare all the legally required documentation for the worker and follow the entire procedure until the start of work.
Article 7.
In accordance with the signing Agreement with the Logistician or the Agency, the Employee will eneter the number of regular and overtime hours every working day via SMS, email, or directly on the website https://workeronline.eu so that Logistician or Agency can monitor his work activities and control the regular payment by the Employer/Agencies.
Article 8.
If the Logistician hires a worker for his own needs, all working conditions will be regulated by the Employment Contract in absolute compliance with positive legal regulations of the country in which the worker works.
Article 9.
On the website https://www.workeronline.eu, the Agency will allow the Employee to enter all his data necessary for a proper application for work. The Agency will hide all personal data of the Employee except information about his work skills, work experience and other information related to the best and highest quality presentation of work abilities. The worker agrees that any short video posted alongside his skills may be publicly available to interested Employers and Agencies.
Article 10.
The Employee may leave the job before the expiration of the Employment Contract only with the express consent of the Employer/Agency, except in the case when is basic labor and human rights are violated and where it is established that the Employee id discriminated against by the Employer/Agency.
Article 11.
A worker who is registered on the website https://www.workeronline.eu has no right to request any logistical support from the Logistician unless he has made a valid Contract with the Logistician.
Article 12.
All business and other relations between the Agency/Logistician and the Worker shall terminate after the completion of the work provided for in Contract between the Worker and Logistician/Employer/Agency, or if the Employment Contract is terminated due non-work and negligence of the Employee, or if it is caused by force majeure until the termination of the Employment Contract which could not be prevented by the Logistician, Worker, Employer or Agency.
General conditions Logistician - Employer/Agency
Article 13.
The Agency will provide the Logistician/Employer with an insight into the available workfoce on the website https://workeronline.eu and provide all additional information so that the Logistician/Employer has the easiest possible choice in temrs of their needs and the quality of the avaliable workforce.
Article 14.
The Logistician will resolve his commercial interests for each business relationship with the Employer or the Agency by a special agreement, and everything will be regulated by a special Contract.
Article 15.
The Employer/Agency may indicate its workforce needs on the website https://www.wokeronlin.eu, but the Logistician is not obliged to indicate the name, registered office and other information about the business entity seking labor except in exceptional cases when the Employer/Agency wants to advertise on page https://www.workeronline.eu , which will be regulated by the Marketing Contract or some other Business Cooperation Agreement.
Article 16.
If it is about workers from countries outside the EEA, the Logistician and the Employer/Agency may in some cases agree and charge the logistical obligations of the Logistician. For easier navigation and/or proximity to the Police administration where the residence and work permits will be issued , Employer/Agency may request the assistance of a Logistician.
Article 17.
The Employer/Agency is obliged to provide exactly each worker with completely equal working conditions in accordance with all applicable laws of the country in which the worker works and regulations governing health and safety at work, and special protection of certain groups of workers. Furthermore, the Employer/Agency undertakes to provide the Employee with all necessary equipment and means for work, and will treat each employee hired through the website https://www.workeronline.eu and/or with the logistical support of the Logistician, as all other employees without any direct or indirect discrimination.
Article 18.
If the Employer/Agency for any reason wants to teminate the Employment Contract with the Employee hired through the Logistician, they are obliged to compensate all damage to the Employee and the agreed compensation to the LogisticianIAgency and everything will be regulated by the Contract and its Appendices. In doing so, the Employer/Agency is particularly aware of the costs of hiring and arriving workers from distant countries whose early termination of the Employment Contract calls into question the orderly return to the country from which theycamoe for temporary work.
Article 19.
All information related to personal data and protection of personal data collected for the purpose of achieving all business intensions in which the Logistician, Worker, Employer, Agency or Subcontractor participates can be viewed at the link https://workeronline.eu/en/home.
Article 20.
Any party that cooperates with the Agency on any business may lose the right to access information and permanently terminate the user account if he enters incorrect and false information or if in any way conceals vital information necessary for the implementation of any Agreement/business relationship.
Article 21.
These General Terms and Conditions are an integral part of each Agreement/Contract that either party signs with the Agency, regardless of whether the General Terms and Coniditions are attached to each Contract in Writing. Each Agreement/Contract in a particular instructs the signatories of the Agreement/Contract to read the General Terms and Conditions at https://www.workeronline.eu .
Article 22.
These General Terms and Conditions were published on the official website of the Agency https://www.workeronline.eu on August 8, 2022 and enter into force 8 days after publication.
